Terms of Service

You must be at least 18 years old and legally capable of entering into a binding contract.

A person using Qwint Caption on behalf of a company confirms that they have authority to bind that company.

• “Software” means the Qwint Caption plugin, installers, scripts, updates, and related software.
• “Templates” means caption styles, animations, MOGRT files, design files, presets, and related digital assets included with Qwint Caption.
• “AI Services” means caption generation, transcription, translation, processing, and related cloud features.
• “Credits” means the usage allowance applied toward eligible AI Services.
• “Package” means the bundled purchase containing the applicable Software licence, Template licence, and AI allowance.
• “Output” means captions, subtitle files, rendered videos, and other results created by a user through Qwint Caption.

Every plan is sold as a bundled digital licence package unless a product is expressly identified as a separate purchase.

The purchase price covers the complete package and is not solely consideration for AI credits.

The package may include:

• A Software licence.
• A Template licence.
• AI credits or subscription access.
• Updates or support for a stated period.

Unless expressly displayed during checkout, no separate monetary value is assigned to an individual package component.

The fact that AI credits remain unused does not mean that the Software and Templates were provided free of charge.

You must provide accurate information and keep your account and licence credentials secure.

You are responsible for activity occurring through your account unless caused by our security failure.

You must promptly notify us of unauthorised access.

We may require reasonable verification before changing account details, resetting activations, processing refunds, or disclosing account information.

Qwint Caption is delivered electronically.

A package is considered delivered when the downloadable files, account access, licence key, or purchased allowance are made available through the stated delivery method.

Download, account, activation, and usage records may be used to verify delivery and resolve disputes.

Your use of the Software and Templates is governed by the EULA and Template Licence.

Unless the selected plan states otherwise, a licence is:

• Non-exclusive.
• Non-transferable.
• Non-sublicensable.
• Limited to one named user.
• Limited to two devices owned or controlled by that user.
• Subject to these Terms.

You purchase a right to use the Software and Templates. You do not purchase their ownership or intellectual-property rights.

A one-time plan may provide a continuing licence to the eligible Software and Templates delivered with the purchase.

Updates are included only for the period stated on the Pricing Page. Current one-time plans include updates for one year unless otherwise stated.

Continued compatibility with future Adobe versions, operating systems, hardware, or third-party software is not guaranteed.

A subscription provides access during the paid subscription term.

Subscriptions renew automatically at the displayed billing interval until cancelled.

You authorise us and our payment provider to charge the applicable fee and taxes at each renewal.

Cancellation stops future renewals. Unless required by law, cancellation does not provide a prorated refund for the current billing period.

When a subscription expires:

• AI access may stop.
• Software activation may be disabled.
• The right to use Template source files obtained under the subscription ends.

Previously completed and rendered videos may continue to be displayed, provided they were created while the licence was valid and no infringement or fraud occurred.

Credit amounts and measurement rules are displayed on the Pricing Page or in the Software.

Credits:

• Have no cash value.
• Cannot be transferred between unrelated accounts.
• Cannot be sold or exchanged.
• May be consumed when processing begins.
• Are non-refundable once consumed.
• May be deducted for completed processing even when the user does not use the resulting Output.

Credits included with eligible one-time plans currently do not expire, subject to continued AI-service availability, compliance with these Terms, and any contrary statement displayed at purchase.

If we permanently discontinue an AI Service while paid credits remain, we may offer a substitute service, conversion, reasonable usage period, account credit, or another remedy required by applicable law.

“Unlimited” means that a fixed monthly credit quantity is not displayed for ordinary use by the subscribed human user.

It does not mean unlimited computing capacity or permission for:

• Automated bulk processing.
• Continuous unattended processing.
• Processing services for unrelated third parties at scale.
• Resale of access.
• Account sharing.
• Circumventing restrictions.
• Use that materially harms service availability.

We may apply reasonable processing queues, concurrency limits, rate limits, and abuse controls.

Where practical, we will contact a user before restricting unusual usage unless immediate action is required for security, fraud, or service protection.

Payments may be processed through Razorpay or another disclosed payment provider.

We do not ordinarily receive complete card or banking credentials.

Prices may change for future purchases or renewals. Changes will not retroactively alter a completed one-time purchase.

Applicable taxes and currency information will be displayed during checkout.

You must comply with the Acceptable Use Policy.

You may not use Qwint Caption to:

• Break the law.
• Infringe intellectual-property or privacy rights.
• Distribute malware.
• Gain unauthorised access.
• Abuse AI infrastructure.
• Share or resell licences.
• Circumvent technical restrictions.
• Reverse engineer protected components except where applicable law expressly permits it.

You retain rights you hold in media and other content submitted for processing.

You grant us and our service providers a limited permission to host, transmit, process, convert, and temporarily store submitted content only as reasonably necessary to:

• Provide the requested service.
• Maintain security.
• Diagnose problems.
• Comply with law.

You confirm that you have the rights and permissions required to process the submitted content.

AI Output may be incomplete, inaccurate, offensive, or unsuitable.

You are responsible for reviewing Output before using or publishing it.

We do not guarantee:

• A specific accuracy percentage.
• Error-free transcription.
• Correct translation.
• Speaker identification.
• Legal compliance of Output.
• Uniqueness of Output.
• Suitability for high-risk decisions.

Qwintsoft LLP and its licensors retain all rights in the Software, Templates, website, branding, designs, documentation, technology, and services.

Except for the licence expressly granted, no rights are transferred to you.

We may release updates, corrections, security improvements, or feature changes.

An update may be required to continue using online features.

We may modify or discontinue features for security, legal, technical, or commercial reasons. Where reasonably possible, we will give advance notice of a material discontinuation affecting paid access.

Roadmaps, previews, demonstrations, and “coming soon” statements are informational and are not guarantees.

Qwint Caption depends on third-party services, including Adobe software, payment providers, hosting providers, and AI-processing providers.

We are not responsible for changes or outages caused solely by an independent third party, but we will provide reasonable assistance for issues affecting Qwint Caption.

Use of third-party products may be governed by their own terms.

Support is provided through the channels displayed on the Contact Page.

You agree to provide reasonable information required to diagnose an issue.

We are not required to support:

• Modified or unauthorised copies.
• Unsupported Adobe versions.
• Unsupported operating systems.
• Pirated software.
• Damage caused by third-party modifications.
• Use contrary to documentation.

Refunds are governed by the Refund and Cancellation Policy.

Refund approval terminates the associated Software and Template licences and cancels unused credits related to the refunded purchase.

We may suspend or terminate access where reasonably necessary because of:

• Non-payment.
• Fraud or suspected fraud.
• Licence sharing.
• Chargeback abuse.
• Security risk.
• Illegal activity.
• Material breach of these Terms.
• Harm to the service or other users.

Where appropriate, we will provide notice and an opportunity to correct the breach.

Termination does not authorise continued use of downloaded Software or Template source files.

To the maximum extent permitted by law, Qwint Caption is provided on an “as available” basis.

We do not guarantee uninterrupted availability, complete accuracy, compatibility with every system, or that every error will be corrected.

Nothing in these Terms excludes a warranty, guarantee, remedy, or consumer right that cannot legally be excluded.

To the maximum extent permitted by law, Qwintsoft LLP will not be liable for indirect, incidental, special, punitive, or consequential loss, including loss of profits, data, opportunity, goodwill, or business interruption.

Our aggregate liability arising from the affected purchase will not exceed the amount paid by you for that purchase or, for a subscription, the amount paid during the 12 months before the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including liability arising from fraud, wilful misconduct, or another non-excludable obligation.

When using Qwint Caption for business purposes, you agree to indemnify Qwintsoft LLP against third-party claims resulting from:

• Content you process without permission.
• Your infringement of third-party rights.
• Illegal use.
• Your material breach of these Terms.

This section does not apply to the extent a claim was caused by Qwintsoft LLP.

These Terms are governed by the laws of India.

Subject to statutory consumer rights and the jurisdiction available under consumer-protection law, courts with jurisdiction over Rajkot, Gujarat will have jurisdiction over disputes.

Before starting legal proceedings, the parties should attempt in good faith to resolve the matter through written communication for at least 30 days.

Nothing in this section prevents an eligible consumer from using a consumer commission, statutory regulator, or other remedy available under applicable law.

We may update these Terms.

Material changes will apply prospectively and will be communicated through the website, Software, account, or registered contact information.

The version accepted at purchase will continue to govern completed one-time purchases to the extent required by law.
